Terms & Conditions – WHIFF

These Terms & Conditions apply to the online store operated by WHIFF Oy (“WHIFF”), the use of the WHIFF website, and all orders placed through the online store.

These Terms apply together with WHIFF’s Return & Refund Policy, Privacy Policy, and any other applicable policies published on the website.

Nothing in these Terms limits any mandatory rights granted to consumers under applicable Finnish, European Union, or other applicable consumer protection legislation.

1. WHIFF and Use of the Website

The online store is operated by WHIFF Oy.

Customers are responsible for ensuring that all information provided when placing an order, including name, address, contact, delivery, and payment information, is accurate, complete, and up to date.

The website may not be used for unlawful or fraudulent purposes or in any manner that infringes the rights of WHIFF or any third party.

WHIFF reserves the right to modify the website and these Terms & Conditions. Orders are generally governed by the Terms & Conditions in force at the time the order is placed.

2. Products

WHIFF sells authentic fragrances, cosmetics, and related products.

Part of WHIFF’s selection consists of 5 ml and 10 ml decant products. A decant contains original fragrance transferred from the original manufacturer’s product into smaller packaging used by WHIFF.

Unless expressly stated otherwise in connection with a product, the bottles, labels, and packaging used for WHIFF decants are not manufactured or packaged by the original fragrance brand.

WHIFF is not the manufacturer, owner, official website, authorised retailer, distributor, or representative of the brands referenced on the website unless such status is expressly stated.

Third-party trademarks and product names are used solely to identify and describe the products and their origin.

3. Product Information and Availability

WHIFF makes reasonable efforts to ensure that product descriptions, prices, photographs, and availability information displayed on the website are accurate and up to date.

Manufacturers may, however, modify product packaging, appearance, formulation, or other product characteristics without WHIFF’s control.

All products are subject to availability.

WHIFF may limit the quantity of individual products purchased where there is a legitimate reason to do so.

4. Prices and Payment

Product prices are displayed in the online store in accordance with the tax and pricing requirements applicable to the customer.

Any applicable delivery charges and other charges payable by the customer are displayed before the order is finally confirmed.

The customer is responsible for providing accurate information required by the selected payment method.

Orders delivered outside the European Union may be subject to customs duties, import taxes, or other local charges in accordance with WHIFF’s terms concerning international deliveries.

5. Orders

After an order has been placed, an order confirmation will be sent to the email address provided by the customer or otherwise made available through the online store.

In exceptional circumstances, WHIFF may cancel an order where there is a legitimate reason to do so, including where:

• the product is no longer available;
• there is an obvious pricing or product-information error;
• payment cannot be authorised or verified;
• there are reasonable grounds to suspect fraudulent activity;
• fulfilling the order would be unlawful; or
• another material circumstance outside WHIFF’s reasonable control prevents fulfilment of the order.

If WHIFF cancels an order that has already been paid for, the amount paid by the customer will be refunded in accordance with applicable law.

6. Delivery

WHIFF aims to process and deliver orders within the delivery times indicated in the online store.

Unless expressly agreed as binding, delivery times are estimates.

Delays may occur due to carriers, customs or authorities, exceptional weather conditions, industrial action, service disruptions, or other circumstances outside WHIFF’s reasonable control.

Nothing in this section limits any mandatory rights available to customers under applicable law in the event of delayed delivery.

7. Withdrawal and Returns

Consumers have a right of withdrawal where the requirements of applicable consumer protection legislation are met.

Detailed provisions concerning withdrawal, returns, sealed or hygiene-protected products, decant products, and refunds are set out in WHIFF’s Return & Refund Policy.

Nothing in these Terms limits the customer’s statutory rights in relation to defective, incorrect, damaged, or otherwise non-conforming products.

8. Incorrect, Damaged or Defective Products

If a product delivered to the customer is incorrect, damaged, defective, or otherwise does not conform to the contract, the customer should contact WHIFF without undue delay after discovering the issue.

WHIFF will handle such matters in accordance with applicable consumer protection legislation.

9. Limitation of Liability

To the extent permitted by applicable law, WHIFF shall not be liable for indirect or consequential losses.

WHIFF shall not be liable for losses, disruptions, or delays caused by circumstances outside WHIFF’s reasonable control, except where liability arises under mandatory applicable law.

Nothing in these Terms excludes or limits any liability of WHIFF that cannot lawfully be excluded or limited under applicable mandatory legislation.

10. Intellectual Property

Texts, photographs, graphics, WHIFF trademarks, visual elements of the website, and other original content created or owned by WHIFF are the property of WHIFF or its licensors and are protected by applicable intellectual property laws.

Third-party trademarks, logos, product names, and other protected identifiers remain the property of their respective owners.

Third-party trademarks are used on the website to identify and describe products. Such use does not, by itself, imply any affiliation, sponsorship, endorsement, authorisation, or other commercial relationship between WHIFF and the relevant trademark owner.

Unauthorised copying, publication, commercial exploitation, or other unlawful use of WHIFF’s protected content is prohibited to the extent permitted by applicable law.

11. Governing Law and Dispute Resolution

These Terms & Conditions and contracts entered into through the WHIFF online store are governed by the laws of Finland, subject to any mandatory consumer rights available under applicable law.

Any dispute should primarily be resolved through negotiations between the customer and WHIFF.

Consumers may, where applicable, refer a dispute to the Finnish Consumer Disputes Board (Kuluttajariitalautakunta). Consumers in Finland may also contact consumer advisory services before referring a matter to the Consumer Disputes Board.

Nothing in these Terms limits a consumer’s right to bring a claim before a competent court where such right exists under applicable law.
